Terms of service

These Terms of Service govern your use of and any order you place through it. By browsing the site or placing an order, you agree to these terms. If you do not agree, please do not use the site. These terms work together with our Shipping Policy, Returns & Refunds Policy, Payment Policy, and Privacy Policy, each of which is linked in the site footer. Where those policies address a specific topic in more detail, they control on that topic.
1. Who we are. Evrykitchens is an independent online retailer operating from 2203 N 50 W, Albion, IN 46701, United States. References to “we,” “us,” and “our” mean Evrykitchens. References to “you” mean the person visiting the site or placing an order. You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you order on behalf of a business, you confirm you have authority to bind that business to these terms.
2. Orders and acceptance. Submitting an order through checkout is an offer to buy, not a completed contract. We accept your offer when we process the order for shipment and send a shipping confirmation. Until that point, we may decline or cancel an order—for example if an item is out of stock after you order, if we cannot verify the payment or shipping details, if the order appears to be for resale rather than personal use, or if we suspect fraud. If we cancel an order after your payment method has been charged, we refund the full amount to the original payment method. You will be notified at the email address on the order if any part of an order is declined or cancelled.
3. Pricing and product information. Prices are shown in United States dollars and are the amount charged at checkout, excluding any fees your own bank or card issuer may assess. We try to describe items accurately, including dimensions, materials, and care instructions, but we do not warrant that every description, photo, or specification is free of error. If an item arrives and does not match its description in a material way, our Returns & Refunds Policy applies. If a pricing error occurs—for example a price listed far below its actual value due to a data or system error—we may cancel the affected order before shipment and refund any amount already charged. We will contact you before cancelling in that situation so you can decide whether to reorder at the corrected price.
4. Payment. We accept Visa, MasterCard, and PayPal as described in our Payment Policy. Your payment method is authorized at checkout and captured when the order is processed for shipment. You confirm that the payment information you provide is yours to use and that the billing details you supply are accurate.
5. Shipping, returns, and refunds. Delivery timelines, shipping costs, the return window, return shipping cost, and refund timing are set out in our Shipping Policy and Returns & Refunds Policy. Those pages form part of these terms. In summary: standard shipping within the contiguous United States is free, orders are processed in 1–2 business days, delivery takes 3–5 business days after processing, returns are accepted within 30 days of delivery with free return shipping and no restocking fee, and refunds are issued within 1–2 business days of the return arriving at our facility and post to your original payment method within 7–10 business days. The detailed policies control if any summary here is incomplete.
6. Your account. If you create an account, you are responsible for keeping your login credentials confidential and for activity that occurs under your account. Notify us promptly at info@evrykitchens.com if you believe your account has been accessed without authorization. We may suspend or close an account that we reasonably believe is being used for fraudulent orders, abusive conduct toward our team, or activity that interferes with the site.
7. Acceptable use. You agree not to use the site to place fraudulent orders; to scrape, copy, or republish site content for commercial purposes without our written permission; to attempt to gain unauthorized access to our systems or another customer’s account; to introduce malicious code; or to interfere with the site’s normal operation. We may restrict or terminate access for conduct that violates this section.
8. Intellectual property. The Evrykitchens name, the site’s design and layout, and the product descriptions and photographs we create are our property or are used by us under license, and may not be reproduced without our written permission. Product names, logos, and trademarks belonging to the manufacturers of the items we sell remain the property of those manufacturers. Nothing on this site grants you a license to use any trademark or copyrighted material except as needed to browse the site and place an order.
9. Reviews and submissions. If the site allows you to submit a review, question, or other content, you grant us a non-exclusive, royalty-free license to display and use that content in connection with the site. You confirm that anything you submit is your own and is accurate to the best of your knowledge. We may remove content that is unlawful, misleading, or unrelated to the product it is attached to. We do not edit reviews to change their meaning.
10. Disclaimer of warranties. Except as expressly stated in our Returns & Refunds Policy or required by law, items are sold without additional warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. Nothing in these terms limits any warranty or right that cannot be limited under applicable law.
11. Limitation of liability. To the fullest extent permitted by law, Evrykitchens is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or from any order, including lost profits or lost data. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. These limits do not apply to liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
12. Indemnification. You agree to indemnify Evrykitchens against claims, losses, and reasonable legal costs arising from your breach of these terms or your misuse of the site, except to the extent the claim results from our own negligence or misconduct.
13. Governing law and disputes. These terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law rules. Before filing any formal claim, you agree to contact us at info@evrykitchens.com with a description of the dispute and to allow 30 days for us to try to resolve it. If a dispute is not resolved through that process, it may be brought in the state or federal courts located in Indiana, and both parties consent to jurisdiction there. Nothing in this section prevents either party from seeking relief in a court of competent jurisdiction where the law requires it, or affects any statutory right you have as a consumer in your place of residence.
14. Changes to these terms. We may update these terms to reflect changes in our practices or in applicable law. The revised version takes effect when it is posted on this page with an updated date. Changes do not apply retroactively to orders already placed. If a change materially affects how we handle existing orders, we will notify affected customers by email.
15. Severability and entire agreement. If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with the Shipping, Returns & Refunds, Payment, and Privacy policies, are the entire agreement between you and Evrykitchens regarding use of the site and orders placed through it.
